Our Father’s House (We or the Service) agree to be bound by this Terms of Service (TOS) when we process your information on our template order form, free trial form or enter into an agreement with you by phone or other means. You (Customer) agree to be bound by this TOS when you submit your information on our template order form, free trial form or enter into an agreement with us by phone or other means.

We reserve the right to change, modify, add or remove all or part of the TOS at any time.

We lease your website template to you. We maintain the hosting environment for all of our website templates. Access to the Visual Editor and other features of the Our Father’s House service are privileges for customers. They are not a right. You agree that these privileges may be limited or terminated at any time should we deem your traffic dangerous to the internet reputation of our servers or domain names.

You may not place excessive burdens on our CPUs, servers or other resources. You agree that we may place restrictions on your use of our service to the extent that your use exceeds the use by similarly situated customers.

By accepting this TOS you warrant you are 18 years old or older, agree to provide true, accurate, current and complete information about yourself, agree to maintain and update this information to keep it true, accurate, current and complete. If any information you provide is untrue, inaccurate, not current or incomplete, we have the right to terminate your account and refuse any and all current or future use of the the Service.

On occasion, we may need to communicate with you by email about your service. You agree to maintain a working email address that is monitored daily. We have no responsibility or liability for interruptions in service based on communications that are not received as a result of your failure to provide us with updated contact information.

All payments, after the free trial, are made prior to the period of service being provided unless otherwise noted. Once you sign up for the Service we will retain a valid credit card where over-due invoices can be charged without notice.

Our obligation to provide service to you is contingent upon your payment of the fees by your due date. It is your responsibility to ensure that we receive payment. We may temporarily deactivate websites for nonpayment 5 days after the due date.  

Refunds will be carried out at our discretion.

You may cancel your account at any time. if the cancellation request is received within 5 working days of the next billing cycle you will be billed for the following month.

Upon termination or cancellation, your account will be closed. We have no responsibility to forward email or website traffic or other communications for you once your account is closed.

You may not claim intellectual or exclusive ownership to any of our products; modified or unmodified. All products are the property of Our Fathers House. In no event shall Our Father’s House be liable for any damages including, but not limited to, indirect, direct, incidental, special, or consequential damages or other losses arising out of the use of or inability to use the templates.

We hereby grant the Customer a non-exclusive, non-transferable license to use the Service on a server controlled by Our Father House for the sole purpose of creating and maintaining a website. The templates may not be shown, resold, or redistributed in any sort of collection. It is an infringement of copyright to redistribute or resell our templates without our consent or written permission. You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Our Father’s House.

Templates are provided ‘as is’ without warranty of any kind, either expressed or implied. You are responsible for adding or editing your website’s content (e.g. pictures, photos, and text) to the template yourself.

Customer grants Our Father’s House the right to maintain Customers content on the Our Father’s House servers during the term of agreement.

Customer shall not attempt to gain unauthorized access to any servers controlled by the service provider.

THE SERVICE AND SOFTWARE ARE PROVIDED ON AN AS IS BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THIS AGREEMENT OR ANY DOCUMENTATION FURNISHED UNDER IT IS INTENDED TO EXPRESS OR IMPLY ANY WARRANTY THAT THE OUR FATHER’S HOUSE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE OR THAT THE SOFTWARE WILL PROVIDE UNINTERRUPTED, TIMELY OR ERROR FREE SERVICE. THE SECURITY MECHANISM INCORPORATED IN THE SOFTWARE HAS INHERENT LIMITATIONS AND SITE OWNER MUST DETERMINE THAT THE SOFTWARE ADEQUATELY MEETS ITS REQUIREMENTS. SITE OWNER ACKNOWLEDGES AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT ITS OWN DISCRETION AND RISK AND THAT SITE OWNER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO ITS COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA. THE SERVICE PROVIDER, AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES AND AGENTS, SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES OR LEGAL THEORIES WHATSOEVER, FOR ANY LOSS OF BUSINESS, PROFITS OR GOODWILL, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, EVEN IF THE SERVICE PROVIDER IS AWARE OF THE RISK OF SUCH DAMAGES, THAT RESULT IN ANY WAY FROM SITE OWNER USE OR INABILITY TO USE THE  OUR FATHER’S HOUSE SERVICE, OR THAT RESULT FROM ERRORS, DEFECTS, OMISSIONS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY OTHER FAILURE OF PERFORMANCE OF THE  OUR FATHER’S HOUSE SERVICE.

You agree that Our Father’s House has no liability, whatsoever, for unauthorized access to, or any corruption, erasure, theft, destruction, alteration or inadvertent disclosure of, data, information or content, transmitted, received, or stored on our system.
